He was the executor of his father's will. His will was probated on 20 Jan 1767 in Surry County Virginia. He was co-executor of his father-in-laws will. He was a planter in Surry County and made several land transactions there.
In the will of the children's grandfather Thomas Collier , made 15 Feb 1727, "Sick and Weak in body", bequest item 11 to Mary, 12th item concerns William and Thomas. If order of precedence means anything, possibly birth dates from other sources may be incorrect. Matthias and Benjamin are not mentioned.
The Will Of William Marriott:
In the name of God Amen, I William Marriott of the County of Surry make this my last will and testament. First i resign my soul to it's creator in all humble hope of it's future happiness through the merits and meditations of Jesus Christ- As to what temporal estate it hath pleased God to entrust me with I dispose in manner following. Viz after paying my just debts.
I give and devise to my son Thomas Marriott my plantation in the County of Brunswick and the land ajoining on the south side of Maharen River and on the North of the Avents(sic)Creek also two acres of land adjoining the mill on the other side of the said Creek to him and his heirs forever. I give and devise my son Thomas the following slaves to wit Roger, Sue, Ned, Pat(sic), and her children; also my boy mun to him and his heirs forever.
I give and devise my son Matthias Marriott one Mocety(sic)of my land in Wire Neck(sic)by my estimation Viz. that part of lying on the creek within the line i have made to him and his heirs forever.
The other part of my land in Wire Neck which i have divided by an line of marked trees that had into a branch which completes the division that part of it that has the plantation whereon my son Benjamin Marriott lived and lies on the mill swamp.
I give and devise to my grandson William Marriott,younger son of Benjamin with half the stock that shall be on said plantation when his brother John Marriott comes to the age of eighteen to him and his heirs forever to be entered upon when he arrives at the age of eighteen years. The other part of which on Sunken Marsh Rd. also the sum of ten pounds with half the stock which shall be upon the plantation whereon my said son Benjamin Dec(sic) lives.
I give and devise to my grandson John Marriott, Elder son of Benjamin when he arrives at the age of eighteen to him and his heirs forever upon the condition that he the said John at that time equally divide the Slaves put into the possession of the said Benjamin Marriott his father by me with all their family, but if he refuse I give the said land and ten pounds also the cattle to his said brother William to him and his heirs forever.
My will is that Stephenson Burton and his wife Elizabeth ejoy the use of Dwelling House wherein he now lives until my grandson William Marriott arrives at the age of eighteen.
I give and devise my grandson William Davis my land in the county of Brunswick lying in the south side of the Advents creek except the two acres above mentioned adjoining my Thomas and the mill to him and his heirs forever.
I give and devise to my son in law Henry Davis the following slaves to wit leny(sic) and Hannah to him and his heirs forever.
The remainder of my estate i give to be equally divided between my two sons Thomas and Matthias and my said Son in law Henry Davis as they can agree.
Lastly, I do nominate and appoint my son Matthias sole executor of this my last will and testament in confirmation which i have here unto set my hand and affixed my seal this twentieth day of September 1765.
I give and devise to my son Matthias Marriott the tract of land and plantation whereon Peter Redborn now lives to him and his heirs forever.I give and devise to my son Matthias Marriott the following slaves to wit lo(sic), Lucy,Daniel, Tom, and Kate to him and his heirs forever. I give and devise to my son Matthias Marriott my negro man Will upon the condition that he the said Matthias pay annually the sum of five pounds currency money if the fellow live ten years towards the maintenance and education of my daughter Mary Davis five smallest children to him and his heir forever
