James was one of four brothers who all fought in the Civil War and was the only one to return. Because of this, James commissioned the design of a memorial to his brothers commonly called "The Melvin Memorial", but properly titled "Mourning Victory", in the Sleepy Hollow Cemetery of Concord Massachusetts. The memorial was designed by James's childhood friend Daniel Chester French who is famous for many sculptures but is probably most identified wit designing of the Lincoln memorial. However French later said of all his sculptures, it was the Melvin memorial that he was most proud.
